Y-Y QUARTER HORSES STALLION BREEDING CONTRACT 2007 Breeding Season This contract is for the year 2007 breeding season, made and entered into on this _____day of _________, 2007, is by and between Y-Y Quarter Horses, here in after designated Stallion Owner, and _______________hereinafter designated Mare Owner. Mare Owner agrees to breed the Mare_______________ (Breed) _______________Reg. No. __________, to the Stallion _______________, (Breed) ___________ Reg. No. ____________ for the Stud Fee of $________ subject to the following conditions: 1. A booking fee of $150 of the above fee is payable with this contract and the stud fee balance will be paid upon the mares being pronounced "safe in foal". The booking fee is non-refundable. 2. The breeding season in force for this contract shall begin February 15, 2007 and close July 30, 2007. 3. Mare must be halter broke, have shoes removed, wormed and vaccinated within 30 days of entering farm. Mare and foal (if applicable) will be periodically wormed and hooves trimmed as needed by Stallion Owner at Mare Owner's expense. 4. The Mare Owner shall agree that each mare offered for breeding shall be in sound breeding condition and free from infection or disease. A copy of the Mare’s registration papers and Health Certificate must also accompany mare upon delivery to Y-Y Quarter Horses. Mares with out of state origin must be accompanied by a current negative Coggins Test. 5. Any mare examined by the attending Veterinarian found not to be, in his opinion, in sound breeding condition shall not be bred. The stallion owner has the option to accept a substitute mare offered by the Mare Owner within that breeding season. 6. The Stallion Owner agrees to diligently try and settle the above named mare and shall have sole discretion of determining the best method of breeding such mare. If, however, the mare does not settle, the Stallion Owner shall be held harmless. For mares bred on farm, the live foal guarantee is null and void for any mare removed from Y-Y Quarter Horses before being checked "safe in foal" by attending Veterinarian. 7. Live Foal Guarantee. Live foal means the foal shall stand and nurse. It is understood if the mare proves barren, aborts her foal or if the foal is stillborn, a return season will be guaranteed for the following year breeding season only, providing notification is given. Proper notification shall be defined as follows: written certification by a licensed veterinarian within seven days that the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Mare Owner subsequent to the mare's departure from Y-Y Quarter Horses. Booster rhinopneumonitis vaccinations must be administered as indicated by the individual drug manufacturer as the mare progresses through her pregnancy. Failure to do this will void live foal guarantee. An additional chute fee of $150.00 will be charged for return season breeding service. 8. It is further agreed that should the above named stallion die or become unfit for service during the breeding season that the stud fee, less expenses owed by the Mare Owner, will be refunded if it has been paid in full, thereby canceling this contract. No refund will be made should the stallion die or become unfit for service after the end of the breeding season. In this case, the Mare Owner may rebreed the above named mare during the following season to another available stallion on the farm. 9. If the above named mare dies or becomes unfit to breed before or after being pronounced safe in foal, the Mare Owner may substitute another mare with the agreement of the Stallion Owner. 10. A breeder's certificate will be issued to Mare Owner after all expenses have been paid in full and notification of foal birth 11. A finance charge of 1.5% of the unpaid balance will be charged on all balances remaining due past thirty (30) days. 12. Waiver of Liability. Both parties agree that Y-Y Quarter Horses, its owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of the above named mare, accompanying foal or any other horse on its premises. 13. This contract is non-assignable and non-transferable. 14. This contract is entered into in the State of Montana and will be interpreted and enforced under the Laws of Montana. If any clause in this contract is against State Law, then that clause shall be null and void. The balance of the contract will remain in force. 15. Both parties agree to settle any disputes to this contract by arbitration in Missoula, Montana. 16. The following riders are attached hereto and made a part hereof. See attachments 1 – 3 dated 8/02/05 17. This contract represents the entire agreement between the parties. No other agreements, promises, verbal or implied, are included unless specifically stated in this written Contract. The original contract will be kept on file at Y-Y Quarter Horses and a copy provided for Mare Owner. When Mare Owner and Stallion Owner have signed this Contract, it will then be binding on both parties, subject to the above terms and conditions.
